Repeat Offender Indicted on Heroin Possession, Evidence Tampering Charges

Red Bank man pleaded guilty to drug charges last year

A Red Bank man with a criminal record has been indicted on drug possession and tampering with evidence charges stemming from a January incident.

A grand jury has indicted Avery D. Carroll, 37, of 14 Tower Hill Drive, on the charges lodged against him by Red Bank police on Jan. 9 for possession of a controlled dangerous substance, by "knowingly or purposely, obtaining or possessing, actively or constructively," heroin.

Carroll also stands accused of tampering with physical evidence, by "altering, destroying, concealing or removing" the heroin during the investigation surrounding his arrest.

The heroin possession charge is a third-degree crime; and the tampering charge is a fourth-degree offense.

When arrested at a Maple Avenue home in Red Bank on these charges, Carroll had been indicted on eluding charges for allegedly not stopping when signaled by police and leading an officer on a motor vehicle chase through Red Bank and Little Silver.

According to the complaint warrant records of the the Jan. 9 drug arrest, Carroll was in possession of 21 bags of heroin labeled "24/7" and a hypodermic syringe (paraphernalia). He allegedly attempted to dispose of/destroy the heroin in transport to headquarters after the arrest, the complaint warrant said. 

Carroll pleaded guilty to a separate drug charge lodged against him in March of 2012.

An indictment does not constitute a conviction.
